Terms & Conditions 

By clicking “I agree” or signing up for service, you (“Client”, “Customer”, “you”, “your”, and the like) are agreeing to subscribe to Klick Networks, LLC’s ("Klick Networks",Klick-Net”, “us”, “we”, “our” and the like) internet service (‘the Service”) on your selected service plan or package (your “Service Plan”). You are also indicating that you have read and agree to the following terms and conditions and agree to any other terms and conditions on our website (the amalgamation of all terms and conditions in this document along with any terms and conditions found anywhere else on our website shall be known hereinafter as “Terms and Conditions” or "T&Cs").


1. PRICE AND PAYMENT

You agree to pay Klick-Net the equipment fees (if any), monthly recurring fees, and any other installation fees and charges related to your Service Plan (including for any changes or for termination of your Service Plan) identified by us from time-to-time plus applicable taxes (amalgamation of all fees chargeable to you shall be known hereinafter as “Fees”). We will charge your Fees to your credit card commencing on the Service Date (as defined below), monthly in advance for recurring charges for the remainder of your Service Plan, as well as for any other fees and charges that may become payable from time to time. You authorize us and any third party that processes payments on our behalf to use your credit card and retain your credit card and payment information for any outstanding balances and you waive pre-notification of the amounts and dates of the charges to your credit card. If we are unable to charge your credit card after 14 days past the payment date, we will suspend service. If we are unable to charge your credit card after 30 days past the payment date, we will terminate your Service Plan and reclaim our equipment from your premises. This termination does not release you from your responsibility to pay the fees for the Service Plan or a Cancellation Fee, if applicable.

 

2. INSTALLATION & SPECIFICATIONS

We will either contact you via email/phone/sms or provide you access to an online scheduling tool to arrange an installation time. You authorize us to access your property to install our equipment on your property/premises.

3. DURATION OF AND CHANGES TO SERVICES

Your Service Plan will start on the day when Klick-Net is installed and ready for use in your home or business (the “Service Date”) and will continue for the length of time you selected (“Term”).

Month-to-Month Term

You will be billed your Fees at the published rate to which you agreed when you subscribed to you Service Plan, including any discounts that applied when you subscribed. Month-to-month will renew, and be billed, automatically each and every month until you tell us you would like to cancel. Service Plans may be cancelled without fee or penalty, with a minimum of five (5) full days from your service/renewal date. For example, if you tell us you want to cancel your month-to-month service on April 15th (“Cancellation Notice Date”), and your service renewal date is May 1st, the day on which your billing will cease, and your service will end, May 1st (“Termination Date”).

 

4. SERVICE PLAN TERMS AND CONDITIONS

Upgrades: A Request for an upgrade can be submitted at any time and will usually be completed within five to seven business days of receipt of the Request. You will not be charged an activation fee for an upgrade. Any prorated credits for the remainder of the month of lower bandwidth will be applied to the first payment for the upgraded Service Plan.

Moves: A Request for a move, within a Klick-Net coverage zone, can be submitted at any time by contacting Klick-Net Customer service. By submitting a Request for a move, you are ordering a new Service Plan for your new location (“New Plan”) and terminating the former Service Plan (“Old Plan”). Termination of the Old Plan will take effect as of the Service Date for the New Plan. In this instance, the Cancellation Fee set out below will not apply.

However, you will be charged an equipment fee for the New Plan along with an installation fee. Please note that a Request for a move outside of Klick-Net’s coverage area will be treated as a Cancellation, as described below.

Downgrades: We will downgrade your services effective on the last day of your current service. Your downgrade will result in starting a new plan effective your existing service/renewal date. You will not be eligible for any upgrade promotions for at least 6 months from the date of your downgrade. 

Cancellation: We will stop billing for Services on the last day of your service/renewal date AFTER we receive your cancellation request provided you submit the request at least 5 days before your service/renewal date. We suggest you plan to NOTIFY KLICK-NET OF YOUR INTENT TO CANCEL THE SERVICE AT LEAST 30 DAYS IN ADVANCE.

5. SERVICE PERFORMANCE

While we pride ourselves in going to extraordinary lengths to ensure the best possible levels of performance and reliability, particularly within coverage areas that are not easily connected, we do not guarantee that the Service will be uninterrupted. This applies for reasons that may be our fault or may be the fault of others. You acknowledge that you will not be entitled to any service credits or to any other kind of compensation or remedy. We will repair and restore service as quickly as possible. You acknowledge that weather, area power outages our beyond our control and we will do our best to remedy issues as quickly as possible.  You also acknowledge that Klick-Net does not control and is not liable for any content transmitted using your Service Plan. We do not warrant or guarantee the security, accuracy, destination, availability or any other aspect of information transmitted.

6. YOUR RESPONSIBILITIES

Your information. You must provide accurate and complete information about yourself and your business (as applicable). If your information changes, you must promptly update us in writing via our Customer Service page. If we do not believe the information is accurate, we may choose not to provide you with the Service Plan.

Your Stuff. You are responsible for providing at your premises space, power, and an environment (“Your Stuff”) sufficient for the Router Specifications in a room of your choosing. If we believe Your Stuff is likely to cause hazard or service obstruction, you will try to eliminate this likelihood at our request.

Your cooperation. You will cooperate with us, including but not limited to responding to all reasonable requests for information and facilitate our installation and delivery of your Service Plan to you. You will comply with any restrictions on the use of the services, and with any use policies or instructions, we communicate to you. While we know you’ll want to fix any issues you may encounter with your Service, you agree NOT to tamper with any equipment belonging to Klick-Net, whether it is located inside or outside your home or your business, or anywhere else.

Community Relay. Our wireless network is built on the principal of a Community micro-network. Which means that in order to deliver you internet we sometimes rely on our customers to help us by hosting a relay node at their location. This relay node may be on the house, out-building, fence or a pole. The relay nodes help us deliver service to you and in turn you help your neighbors by being a relay to help us relay the service to them. As our network expands we may remove or add a relay node at your location. When we need you to host a relay node we will contact you in advance about the need. We'll also offer you a free month of service for being a host. 

Acceptable Use Policy. You will comply with Klick Networks’ Acceptable Use Policy available on our website.

7. TERMINATION

If either of us is in breach of this agreement, the one that is not in breach can terminate this agreement and your Service Plan by providing 30 days written notice. If either of us goes into bankruptcy, receivership, or similar proceeding, the other can terminate this agreement and your Service Plan. Upon termination of the Service Plan, you will pay Klick-Net all amounts owing and you will return the equipment or allow Klick-Net retrieve our equipment. 

8. PRIVACY

You authorize Klick-Net to collect, use, transmit, process and store information relating to you and your business (as applicable) as described in the most current version of the Klick-Net Privacy Statement.

10.  CHANGES TO THESE TERMS

We may make changes to this agreement from time to time. You can review the most current version of this agreement on our website. Your continued use of your Service Plan indicates you agree to the most current version.

 

11.  WARRANTIES & SERVICE LEVEL AGREEMENTS

With respect to the warranty statements made above, it is important for users of Klick-Net to note the following:

Service Level Agreements for (Packages) for Home

If you select a package designated as “For Home”, telephone, website and email support will be available to you daily from 8 a.m. – 5 p.m. Pacific time, not including statutory holidays. Calls or messages will be responded to within one (1) business day at the latest.

Service Level Agreements for (Packages) for Business

If you select a package designated as “For Business”, telephone, website and email support will be available to you daily from 7 a.m. – 6 p.m. Pacific time. After hours emergency support will also be available, and may be chargeable to you depending on the issue, and the time of day or night. Calls or messages will be responded to within one (1) business hour at the latest.

12.  DISCLAIMER OF CERTAIN DAMAGES

UNDER NO CIRCUMSTANCES WILL WE (INCLUDING OUR CONTRACTORS OR LICENSORS) BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES; FOR LOSS OF PROFITS OR ANTICIPATED SAVINGS; OR FOR LOSS OR CORRUPTION OF DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

 

13.  LIMITATION OF LIABILITY AND EXCLUSIVE REMEDIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR (INCLUDING OUR CONTRACTORS AND

LICENSORS) MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS AND CAUSES OF ACTION ARISING OUT OF, BASED ON, RESULTING FROM OR IN ANY WAY RELATED TO THIS AGREEMENT OR YOUR SERVICE PLAN WILL BE TO RECOVER THE ACTUAL AMOUNT OF DAMAGES YOU INCUR UP TO THE AMOUNT YOU PAID, IF ANY, TO US FOR THE SERVICE PLAN IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR, IF YOU HAVEN’T PAID ANYTHING TO US IN THOSE THREE (3) MONTHS, FIVE DOLLARS (USD $5.00).

14.  APPLICATION OF LIMITATIONS OF LIABILITY

Each of the limitations of liability in Sections 11 and 12 apply for all causes of action including (a) breach of contract, (b) breach of warranty, (c) tort, including negligence and misrepresentation, (d) strict liability, or (e) any other cause of action, to the maximum extent the exclusions and limitations are not prohibited by applicable law. Certain laws do not allow limitations on implied warranties, or the exclusion or limitation of certain damages. If these laws apply, some or all of the above disclaimers, exclusions, or limitations, may not apply to you, and you may have additional rights to those contained herein.

 

15.  INDEMNIFICATION

You agree to indemnify us (including our directors, officers, employees, agents, suppliers and contractors) harmless from and against any and all costs, liabilities, losses and expenses (including, but not limited to, reasonable legal fees and expenses) resulting from any claim, suit, action, or proceeding brought against any of us by third parties arising from your use of your Service Plan.

 

16.  GENERAL

Governing Law. This agreement is governed by the laws of the State of Washington and applicable laws of the United States of America.

Severability. If a court determines that part of this agreement is invalid, the rest of the provisions are still applicable.

If any provision is deemed unenforceable, where possible, it will be modified to the extent necessary to make it enforceable. Assignment. You may not assign, transfer or sub-license this agreement or your Service Plan. We may. assign this agreement at any time. Performance of Obligations. We may perform our obligations through the use of our affiliates, subcontractors, suppliers or agents but we will remain liable to you. No Waivers. If we fail to act with respect to a breach by you or others, we are not waiving our rights to act with respect to subsequent or similar breaches. A waiver will only be binding on us if it is in a written document signed by us. Entire Agreement. This agreement (including any incorporated terms) constitutes the entire agreement between us with respect to your Service Plan. Survival. After termination of this agreement, the following provisions will survive: 1, 2, 3, 10, 11, 12, 13, 14, 15 and 16.

 

17.  PROMOTIONS

Free Month Offers:

To be eligible, customer residence must be within Klick-Net's coverage zone. Free Month offer period runs for the number of free months indicated in the offer, one time, at the beginning of your subscription Term, after which date billing will automatically commence at the regular rate associated with Service Plan to which you subscribed. YOU AGREE THAT USING THE SERVICE DURING A FREE MONTH OFFER MEANS YOU ACCEPT ALL TERMS AND CONDITIONS OF THE SERVICE PLAN TO WHICH YOU SUBSCRIBED, WHICH INCLUDES THE CANCELLATION CLAUSES HEREIN. Any changes to or cancellation of service after Free Service End Date will be subject to fees in accordance with Klick-Net’s standard terms and conditions. Free Month offers cannot be combined with any other offer. Limit one Free month offer per household or business. All promotions, including Free Month offers, are for a limited time only. Klick-Net reserves the right to terminate and/or modify this offer at any time without prior notice. Outstanding credits on account related to this or any other Klick-Net promotions may only be redeemed for Klick-Net services and are non-transferable.

1. Our commitment to you

Klick Networks, LLC ("Klick-Net") is committed to protecting Personal Information. Klick-Net has established its Privacy Statement using the ten principles, these ten principles are the following:

Klick-Net relies on these ten principles to protect the Personal Information collected from its Customers, Employees and Web Site Users. 

2. Definitions

"Klick Networks, LLC", “Klick-Net”, “we” or “our”:

Means Klick Networks, LLC. and any of its subsidiaries and affiliates as they may exist from time to time.

“Service”, “Klick-Net” or “our network”:

Means Klick-Net’s Network equipment, services, supply contracts, and any supporting personnel engaged in the installation and management of a Klick-Net network.

“Box”:

Means Klick-Net Nodes,  Klick-Net Access Points, routers, antennae and/or other equipment that is connected to the Klick-Net network, and are managed by Klick-Net, whether it is installed inside your home, on the exterior of your home, or elsewhere on the Klick-Net network.

“Business Contact Information”:

Means any information that is used for the purpose of communicating or facilitating communication with an individual in relation to their employment, business or profession such as the individual’s name, position name or title, work address, work telephone number, work fax number or work electronic address

“Customer”, “you” or “your”:

Means an individual who: (a) has an account with Klick-Net; (b) subscribes for, uses, has used, or applies to use Klick-Net’s products and/or services; (c) corresponds with Klick-Net; (d) is a Web Site User; and/or (d) enters a contest sponsored or administered by Klick-Net.

“Employee”:

Any individual who works for, or provides labor to, Klick-Net or one of its affiliate companies in exchange for wages or salary.

“Personal Information”:

Means information about an identifiable individual, for example an individual’s name, account number, e-mail address, payment information, user logs or certain numbers associated with that individual’s equipment (for example MAC address or IP address), if Klick-Net can link such numbers to the individual. It does not include aggregate information that cannot be associated with a specific individual.

“Web Site User”:

Means a user of a website owned, controlled or managed by Klick-Net from which Klick-Net collects Personal Information.

3. Frequently Asked Questions

What type of Personal Information does Klick-Net collect?

a) Customer’s Personal Information:

If you wish to obtain any of Klick-Net's products and/or services, Klick-Net will collect information about you when you subscribe for any of these products and/or services. The type of information we collect varies based on the service you have requested. The Personal Information most often collected and maintained in a Customer file may include (but is not limited to) name, address for service, mailing address, phone number(s), a piece of acceptable identification, alternate contact information, credit card information for payment, and email address.

b) Collection and Use of Box Data:

“Boxes” (devices as described in the Definitions section, above) used by Customers who subscribe to a Klick-Net network, automatically collect raw usage data (the “Usage Data”). Usage Data is collected for network management purposes, diagnostic purposes, for the improvement of overall network performance. Klick-Net creates a database of anonymized and/or aggregated usage behavior by pairing Usage Data with network performance data, including but no limited to matters of security (including illegal, dangerous, and or suspicious use of the Service). This helps Klick-Net understand how Customer behaviors affect the performance of the Service. The collection of Usage Data is critical to operating the Service and cannot be disabled.

c) Collection and Use of Personal information in connection with Klick-Net-managed WiFi:

In order to access the Service, you may opt to buy/rent WiFi equipment from Klick-Net (“Klick-Net WiFi”), which will subsequently be managed by Klick-Net for as long as you are using our services. Your Klick-Net WiFi equipment will have login credentials (username, password, etc.) which Klick-Net will possess, and which is necessary to operate this equipment.  Klick-Net WiFi will also automatically collect certain information such as device location, device type, and general usage information associated to the Media Access Control (“MAC”) address associated with your device (the “Device Information”). The Device Information is used to enable the Klick-Net WiFi to deliver the Service, monitor and improve network traffic, improve your Klick-Net WiFi experience and for research and statistical purposes. We do not know what websites you visit, information you transmit via email or other applications. The data we collect is diagnostic data only that helps us know when/if your equipment is having issues. We do not monitor or access any sites or services you use on the Internet.

d) Employee’s Personal Information

If you are an employee or contractor of Klick Networks, LLC. The personal Information most often collected and maintained in an Employee or applicant for employment file may include, as appropriate, (but is not limited to) Business Contact Information, home address, home phone number(s), emergency contact information, date of birth, Social Insurance Number, banking information, past employment information, resumes, reference letters, earnings information, performance reviews/letters, and dependent and beneficiary information.

e) Web Site User Personal Information

The Personal Information that may be collected in relation to Klick Networks' Web Site Users through an online form typically includes (but is not limited to) name, phone number, email address, physical address.

Collection and Use of anonymous web information through the use of Cookies: During a Web Site User’s interaction with one of Klick-Net’s websites, Klick-Net may use a browser feature called a “cookie” to collect information anonymously and track user patterns on Klick-Net’s websites. A cookie is a small text file containing a unique identification number that identifies a Web Site User’s browser – but not the Web Site User personally – to Klick-Net's computers each time a Web Site User visits one of the Klick-Net websites using cookies. Cookies tell Klick-Net which pages of its websites are visited and how many people visited each web page. This helps Klick-Net understand consumer interests and enhance the on-line experience of visitors to the Klick-Net websites. Cookies also serve to identify your computer so that your preferences can be saved for future visits and advertising based on your previous interaction with the site, Klick-Net works with third parties that use these cookies to help us with such traffic management, research and analytic.

The use of cookies is an industry standard and many major browsers are initially set up to accept them. You can reset your browser to either refuse to accept all cookies or to notify you when you have received a cookie. However, if you refuse to accept cookies, you may not be able to use some of the features available on Klick-Net’s websites.

Third Party Cookies and Advertisements: Some of the advertisements you may see on the Klick-Net websites are delivered by third party advertisers, Internet advertising companies that work on Klick-Net’s behalf or ad networks. These third parties may use cookies or other technology to help deliver ads that are tailored to your interests and track their performance. This is commonly known as “behavioral” or “interest-based advertising.”

Opting out of a network/website does not mean you will no longer receive online advertising. It does mean that the network from which you opted out will no longer deliver ads tailored to your web preferences and usage patterns.

f) Why does Klick-Net collect and use Personal Information?

g) How does Klick-Net obtain your consent?

Consent is generally required for the collection of Personal Information and the subsequent use or disclosure of the Personal Information. Consent can be either express or implied. The form of consent sought by Klick-Net may vary, depending upon the circumstances and the type of Personal Information. In determining the form of consent to use, Klick-Net takes into account the sensitivity of the information and your reasonable expectation, so that you understand the nature, purpose and consequences of the collection, use and/or disclosure of Personal Information. Klick-Net generally seeks express consent when the Personal Information is likely to be considered sensitive. Implied consent is typically appropriate when the Personal Information is less sensitive.

Business Contact Information can be used by Klick-Net without consent solely for the purpose of facilitating communication between Klick-Net and an employee, in relation to his/her employment, business or profession.

In addition, in exceptional circumstances, as permitted by law, Klick-Net may collect, use and/or disclose Personal Information without a Customer’s, Employee’s or Web Site User’s knowledge or consent.

Consent may be obtained in any one of the following ways:

In general, the use of products and services by a Customer, or a Web Site User’s use of a Klick-Net website, or the acceptance of employment or benefits by an Employee, will constitute implied consent required by Klick-Net to collect, use and/or disclose Personal Information for the purposes identified in this Privacy Statement.

Consent may be withdrawn by Customers, Employees and Web Site Users at any time, subject to legal or contractual restrictions and upon providing Klick-Net reasonable notice. If you wish to withdraw your consent to certain collection, retention, use or disclosure of Personal Information, please contact Klick-Net via our Customer Service page. Please note that if you refuse or withdraw your consent, we may not be able to provide you with a particular product or service. We will explain the impact on you at the time, to help you with your decision.an be used for that new purpose.

h) When and how does Klick-Net disclose Personal Information?

Internally, only Klick-Net Employees with a business need to know, or whose duties reasonably so require, are granted access to Personal Information of Klick-Net’s Customers, Web Site Users and Employees.

Klick-Net may disclose Web Site User’s Personal Information to a third party or parties, where the Web Site User has given Klick-Net consent to such disclosure or if disclosure is permitted or required by law.

Disclosure of Personal Information to government organizations, including law enforcement agencies:

Klick-Net is, as are all Internet Service Providers, subject to routine requests from government organizations, including law enforcement agencies. These requests are individually and carefully vetted internally by a team of experts. Klick-Net will only disclose Personal Information in response to these requests when permitted by law.

i) Who does Klick-Net share Personal Information with?

Klick-Net does not sell Personal Information about its Customers, Employees and/or Web Site Users. Klick-Net may share Customers’ Personal Information with its partners, associates and third-party service providers as provided in other parts of this Privacy Statement. In such cases, the relationship with the partner, associate or third party is governed by strict confidentiality standards and policies to ensure the Customer’s Personal Information is secure and treated in accordance with US laws and with the utmost care and respect.

Except as required or permitted by law, when disclosure is made to a third party other than a Klick-Net partner or associate, or a third party service provider, the consent of the individual shall be obtained and reasonable steps shall be taken to ensure that any such third party has Personal Information privacy procedures and policies in place that are comparable to those implemented by Mage. Such third parties are provided only with such information as is necessary in the circumstances. Personal Information provided to third parties may be used only for the purpose stipulated and is subject to strict terms of confidentiality.

In the event that a third party service provider is located in a foreign country, Customer and Employee Personal Information may be processed and stored in such other foreign country. In such circumstances, the governments, courts or law enforcement or regulatory agencies of that country may be able to obtain access to your Personal Information through the laws of the foreign country. Whenever Klick-Net engages a third-party service provider, we require that its privacy and security standards adhere to this Privacy Statement and applicable United States privacy legislation.

j) How does Klick-Net safeguard your Personal Information?

The nature of the safeguards varies depending on the sensitivity of the Personal Information, the scope of the Personal Information, and the method of storage of that information. More sensitive types of Personal Information will be safeguarded by a higher level of protection, including encryption. Personal Information is predominantly stored in the United States, under strict confidentiality standards, as per guidelines set out in this document. Data is routed domestically for service provision purposes as described elsewhere in this document.

k) How long does Klick-Net retain your Personal Information?

We retain your personal information for as long as it is needed to fulfill the purpose(s) for which it has been collected. Our general retention guideline is a 7-year period, which extends to all our corporate records including our customer & billing database. This allows us to meet our financial accountability and audit obligations. Outside of the 7-year period, retention is defined based on length of time information is needed to meet the purpose(s) for which it has been collected and takes into account the sensitivity of the personal information. For example, we keep records of IP address leases for 1 year after a lease expires.

l) How do I access Klick-Net’s policies and procedures?

Klick-Net makes available to Customers, Employees and Web Site Users specific information about its policies and procedures relating to the management of Personal Information, on our corporate and community websites.

Klick-Net is open about its policies and procedures with respect to the management of Personal Information. Customers, Employees and Web Site Users are able to inquire about Klick-Net’s privacy policies and procedures and obtain an account of the Personal Information Klick-Net holds about them at a minimal cost and without unreasonable efforts on their part. This information is available to Customers and Web Site Users by writing to Klick Networks, and to Employees by email to the attention of the HR Department.

m) How do I access my Personal Information?

You may access and verify your Personal Information held by Klick-Net by submitting a request in writing to Klick-Net. A response will be mailed to the address on your account or file.

Klick-Net will respond to a Customer’s, Employee’s or Web Site User’s request within a reasonable period of time and at minimal or at no cost.

In certain circumstances, Klick-Net may not be able to provide access to all the Personal Information it holds, for example, when the disclosure would reveal confidential business information; if the Personal Information is protected by solicitor-client privilege, or if the Personal Information was collected during an inquiry into a breach of contract or violation of a federal or provincial law.

n) How can I challenge compliance and offer suggestions?

A Customer, Employee or Web Site User of Klick-Net may direct any questions or inquiries with respect to the privacy principles outlined above or about Klick-Net’s privacy practices described in its Privacy Statement to our Customer Service.

Klick-Net will investigate all complaints and respond to all questions asked by its Customers, its Employees and/or Web Site Users. If a complaint is found to be justified, Klick-Net will take appropriate measures to resolve the complaint, which may include amending its policies and procedures.

If Customers, Employees or Web Site Users are not satisfied with Klick-Net’s response, they may contact the Better Business Bureau.

 

4. Your role in protecting your Personal Information

 

Please remember that Klick-Net’s Privacy Statement and our use of your Personal Information only applies to the information you provide. We caution that if you disclose Personal Information or personally sensitive data through use of the Internet such as through chat rooms, communities, bulletin boards or other public online forums, this information is not collected by or for Klick-Net but may be collected and used by other persons or companies over which Klick-Net has no control. It is your responsibility to review the privacy statements of any person or company to whom you choose to link, from or through the use of any Klick-Net Internet services. Klick-Net is not responsible for privacy statements, privacy compliance or other content of any website not owned or managed by Klick-Net or its affiliate companies.

Klick-Net does its best to protect and safeguard Personal Information and we believe there are safeguards you should take as well. Do not share your Personal Information such as bank card numbers, credit card numbers, associated pin numbers or Social Insurance numbers unless you clearly understand the purpose of the request and you know with whom you are dealing. Do not keep sensitive Personal Information in your email inbox or on Webmail.

Provide Klick-Net with one acceptable piece of identification, pin number or passphrase, that will be kept in your Customer account, so we can identify you when you call Mage. If you are asked to assign passwords to connect you to your Personal Information, you should use a combination of letters (upper and lowercases), numbers and symbols and do not use words that can be easily associated with you (example: do not use the name of a family member or pet). We also suggest you change your password regularly. If you are suspicious of any telephone, mail or email promotional campaigns or you suspect fraudulent activity, please contact us to verify that the campaign is a legitimate Klick-Net activity.

Any changes to Klick-Net’s Privacy Statement shall be acknowledged in this Privacy Statement in a timely manner. Klick-Net may modify or remove portions of this Privacy Statement when it feels it is necessary and appropriate. Acceptable Use Policy

INTRODUCTION

The benefits and privileges available from Klick Networks, LLC ("Klick-Net") and the Internet in general, must be balanced with duties and responsibilities so that other users can also have a productive, enjoyable experience. This Acceptable Use Policy (the “Policy”, or “AUP”) was designed to prevent unacceptable uses of our services and equipment as well as to ensure that we are able to provide the level and quality of services that our customers expect. Each customer of Klick-Net is responsible for ensuring that the use of all services provided to such customer complies with this Policy.

If Klick-Net believes, in its sole discretion, that a violation of this Policy (direct, or indirect, including violations by a third party) has occurred, it may take responsive action. Klick-Net is entitled to remove the offending material, establish immediate or temporary filtering, deny access, suspend or terminate Services, or take any other appropriate action, as determined by Klick-Net, in addition to any remedies provided by any agreement to provide Klick-Net's Services.

Klick-Net may investigate incidents involving violations of this Policy, and such violations may subject the customer to civil or criminal liability. In the event of a criminal violation Klick-Net will cooperate fully with law enforcement. The customer is solely responsible for use of their Klick-Net account/service, regardless if such use occurred without the account holder’s consent or knowledge.

Klick-Net may amend this policy at its sole discretion. The continued use of Klick-Net's services after an amended policy has been posted here will be deemed as acceptance of the amended policy.

 

PROHIBITED ACTIVITIES

Illegal/Criminal Activity

Klick-Net services must not be used for any activity that violates any local, provincial, federal, international or any other applicable law or regulation, including the distribution or storage of materials that are contrary to any applicable law or regulation. Prohibited activities include, but are not limited to:

Security Violations

Klick-Net services must not be used to breach the security of any account, network, service, or other system of Klick-Net, or to gain unauthorized access to another network or system. Other security breaches include, but are not limited to:

Klick-Net Services must not be used by any customer (or any of their customers) to send messages (including e-Fax and voice traffic) that have the effect of preventing fair and proportionate use of Klick-Net Services by others. Other email violations include, but are not limited to:

 

SUBSCRIBER AGREEMENT

The customer will indemnify and hold Klick-Net harmless from any claim brought by third parties relating to the customer’s use of Klick-Net's Services. The customer must pay and defend all legal costs (including legal fees) arising from such claims. Upon receiving notice, the customer must immediately notify Klick-Net of any claim or potential claim involving their use of Klick-Net's Services. Failure to do so gives Klick-Net the right to defend such claims at the customer’s sole cost.

Klick-Net makes no warranties of any kind are made, whether expressed or implied, including any implied warranty of merchantability or fitness of Klick-Net's Services for a particular purpose. Klick-Net takes no responsibility for any direct, indirect, incidental, special, consequential, punitive or other damages whatsoever, including, but not limited to, loss of use, data, information or profits from delays, non-deliveries, mid-deliveries, or service interruptions, arising out of, or in connection with, customer use or access of any site.

Klick-Net may cooperate with other Internet Service Providers to discourage and resist any abuse of online procedure and policies. In the event that Klick-Net learns that one of its customers is using other networks in an unacceptable way, Klick-Net reserves the right to take corrective action against such customer upto and including suspending or terminating service.

CONTENT OF ONLINE MATERIAL

Klick-Net is not responsible for, and shall not be held liable for, any damages resultant of any conduct, content, communications, goods and services available on or through Klick-Net's Services.

 

PRIVACY OF COMMUNICATIONS

Klick-Net may at all times monitor the performance of Klick-Net Services electronically to ensure its facilities are operating properly.

The customer acknowledges that Klick-Net has the right, but not the obligation, to monitor or disclose the contents of private communications if Klick-Net, in its sole discretion, reasonably believes that such action is necessary:
